1. Acceptance of these terms
By creating an account or using On The Way, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, please don't use the service.
2. Who can use it
You must be at least 18 years old and able to enter into a binding contract. You agree to give accurate information about yourself and, if you drive, about your vehicle and documents, and to keep that information up to date.
3. What On The Way is — and isn't
On The Way is a cost-sharing carpooling platform. Drivers publish pre-planned personal journeys they are making anyway, and we connect them with passengers travelling the same way, so empty seats can be shared and the journey's fuel cost split fairly. We are a technology provider and a point of introduction.
We are not a taxi company or a transport carrier, and On The Way is not a way to make money. We do not own vehicles, employ drivers, or operate trips, and we charge no fee or commission. Journeys are shared on a not-for-profit, cost-sharing basis: a driver can never receive more than a share of the journey's fuel cost, and must not use the platform to run a transport business. The ride itself is an arrangement between the driver and the passenger. We are not a party to that arrangement.
4. Your account
- You sign in using your phone number, Google account or email, and you're responsible for keeping access to your account secure.
- You're responsible for activity that happens under your account.
- Certain features require verification (see below). We may decline, pause or revoke verification at our discretion to protect the community.
- You may switch between riding and driving when you are not in the middle of a trip.
5. If you drive
To offer rides, you must complete verification and you confirm that:
- You hold a valid driving licence and the legal right to drive the vehicle you list.
- Your vehicle is a private passenger car/SUV, roadworthy, insured and registered as required by Sri Lankan law.
- The documents and photos you submit (NIC, licence, vehicle papers) are genuine and belong to you.
- The fuel type and fuel-efficiency details you submit are accurate. Fuel efficiency is verified by our team before you can publish a journey, because every cost split is calculated from it.
- You will only publish pre-planned personal journeys you are genuinely making anyway — never trips created to carry passengers for reward — and carry no more travellers than you have lawful seats for.
Each number plate may be registered to a single verified driver. Attempting to use a plate that isn't yours may lead to removal from the platform.
6. If you ride
- Book for the number of travellers who will actually ride, and be ready at the agreed pickup point and time.
- Confirm how many travellers actually board when the app asks — final contributions are calculated from confirmed numbers.
- Treat drivers, vehicles and fellow passengers with respect.
- Pay your fuel-cost contribution for the journeys you take, directly to the driver. It will never be more than the maximum shown when you booked.
7. Cost sharing & payment
On The Way is a cost-sharing platform, not a paid transport service. There are no fares, no per-seat prices set by drivers, and no surge pricing. Nobody — neither the driver nor Innovibyte — makes a profit from a journey, and we charge no platform fee and no commission.
- Eligible cost. The only cost shared through the platform is the journey's estimated fuel cost, which the app calculates from the planned route distance, the vehicle's verified fuel efficiency, and the published fuel price.
- How your contribution is calculated. The app divides the fuel cost of each stretch of the route equally among everyone on board for that stretch — the driver included. You contribute only for the kilometres you actually travel.
- The driver always bears a share. A driver can never recover the full fuel cost of a journey: the total of all passenger contributions is always less than the journey's eligible fuel cost.
- Maximum vs final contribution. Before you book, the app shows your maximum contribution — the most you could be asked to pay. Your final contribution, confirmed at the end of the journey, may be equal to or lower than that maximum (for example, when more travellers share the same stretch), but never higher.
- Snapshots. The fuel price and vehicle fuel efficiency used for your booking are fixed at the moment you book. A later change in fuel prices or efficiency details does not change an existing booking's contribution.
- Payment. Contributions are paid directly between passenger and driver, in cash. On The Way does not process, collect or hold any money.
You're responsible for any taxes that apply to you.
8. Safety tools
We provide safety features such as driver verification, women's-safety matching, live tracking, trip sharing, trusted-contact alerts and one-tap SOS. These tools are designed to help keep you safer, but they are aids — not guarantees. They depend on factors outside our control, including device, network and location availability. Always use your own judgement, and contact local emergency services directly in a genuine emergency.
9. Prohibited conduct
You agree not to:
- Provide false information or impersonate anyone.
- Use the service for anything unlawful, unsafe, or harassing.
- Discriminate against, threaten or harm other users.
- Misuse the SOS or safety features, or interfere with the platform's operation.
- Attempt to bypass verification, the plate registry, or our safety matching.
- Use the platform to run a taxi or other for-profit transport service, or seek payment beyond the contribution the app calculates.
10. Ratings & complaints
After a trip, drivers and passengers can rate each other and leave feedback or a complaint. Ratings help keep the community accountable. We may review complaints and act on them, including restricting or removing accounts where appropriate.
11. Suspension & termination
We may restrict, suspend or close an account that breaks these terms, poses a safety risk, or harms other users or the platform. You may stop using On The Way and request account deletion at any time.
12. Disclaimers & limitation of liability
On The Way is provided "as is". Because rides are arranged between users, we are not responsible for the conduct of any driver or passenger, the condition of any vehicle, or what happens during a trip. To the fullest extent allowed by Sri Lankan law, Innovibyte Private Limited is not liable for indirect, incidental or consequential loss arising from your use of the service. Nothing in these terms limits liability that cannot be limited by law.
You agree to indemnify Innovibyte Private Limited against claims arising from your breach of these terms or your misuse of the service.
13. Governing law
These terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka, and the courts of Sri Lanka have exclusive jurisdiction over any dispute. We may update these terms from time to time; we'll change the "last updated" date and, for significant changes, notify you in the app. Continuing to use the service means you accept the updated terms.
